Terms of Service
1. Acceptance of Terms
By accessing or using the Pistons and Props website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time; your continued use of the Service after changes are posted constitutes acceptance of the revised terms.
2. Description of Service
Pistons and Props provides an event platform that may include, but is not limited to: ticket sales and management, event information and schedules, vendor applications and management, car registration, donations, volunteer sign-ups, and related administrative tools. We may add, change, or discontinue features at our discretion.
3. Accounts and Registration
You may need to create an account to use certain features. You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly of any unauthorized use.
4. Purchases, Tickets, and Payments
When you purchase tickets, make donations, pay vendor fees, or complete other transactions through the Service, you agree to pay all applicable fees and taxes. Refund and cancellation policies are as stated at the time of purchase or in separate event-specific terms. We use third-party payment processors; your payment data is subject to their terms and our Privacy Policy.
5. User Conduct
You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Service. You may not:
- Use the Service for any illegal or unauthorized purpose.
- Impersonate any person or entity or misrepresent your affiliation.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or systems.
- Transmit viruses, malware, or other harmful code.
- Scrape, harvest, or collect data from the Service by automated means without permission.
We may suspend or terminate your access if we believe you have violated these terms or applicable law.
6. Intellectual Property
The Service and its content (including text, graphics, logos, and software) are owned by Pistons and Props or its licensors and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent, except as necessary to use the Service for its intended purpose.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Event details, schedules, and offerings are subject to change; we are not liable for changes made by event organizers or circumstances beyond our control.
8. Limitation of Liability
To the fullest extent permitted by law, Pistons and Props and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim arising from these terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
9. Indemnification
You agree to indemnify, defend, and hold harmless Pistons and Props and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.
10. Third-Party Services and Links
The Service may contain links to third-party websites or integrate with third-party services (e.g., payment processors, social login). We are not responsible for the content or practices of third parties. Your use of third-party services is subject to their respective terms and policies.
11. Governing Law and Disputes
These terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles. Any dispute arising from these terms or the Service shall be resolved in the state or federal courts located in Wisconsin, and you consent to personal jurisdiction in those courts.
